KPU to revise regulation on presidential election

The General Elections Commission (KPU) has announced its intention to revise the 2008 Presidential Election Law, which it deems has the potential to trigger discord.

“We will not file [a judicial review proposal to the Constitutional Court], because we agree that the problem lies in the law, but the KPU has the right to clarify the interpretation by revising a regulation,” KPU commissioner Ida Budhiati said as quoted by kompas.com on Friday.

Ida said the KPU would liaise with both presidential tickets before revising KPU Regulation (PKPU) 21/2014 on vote counting and decisions for the 2014 president elect.

She said the revised regulation would deal with requirements stipulated by the law and the Constitution - that a second round election would be held for the same two candidate pairs and that the candidate pair will the most votes would be declared the winner.

On Friday, Constitutional Court chief justice Hamdan Zoelva said the court would hold a session next Monday for a judicial review of Article 159 in the 2008 Election Law proposed by the Forum for Constitutional Lawyers and the Election and Democacy Watchdog (Perludem), to ensure the presidential election would be completed in one round.

Article 159 stipulates that the successful presidential ticket must gain more than 50 percent of the total vote.

There are two presidential tickets in this year presidential election, the Prabowo Subianto-Hatta Rajasa ticket and the Joko “Jokowi” Widodo-Jusuf Kalla ticket.
