MPs decide to refer draft law on CSM to General Legislation Committee

One hundred and thirty three (133) MPs voted for the transfer of the draft law on the Supreme Judicial Council (French: CSM) to the General Legislation Committee for reconsideration. Six deputies voted against and fourteen MPs abstained. 

The MPs voted at a plenary session of the House of People’s Representatives (HPR) held Tuesday, part of the work of which was devoted to the discussion of the bill on the supreme judicial council.

Before taking the decision to refer the bill to the committee, One hundred and twenty nine (129) MPs voted against the discussion of articles of that draft law, while nine deputies voted for and ten abstained.

Minister of Justice Mohamed Salah Ben Issa said the postponement of the discussion of that bill article by article serves the interest of all, to pass the law without opposition.

According to him, the government cannot withdraw the draft law on the CSM submitted for discussion to the HPR. The initiator of the bill cannot withdraw it after its submission to the plenary session as stated in article 137 of the Rules of Procedure of the parliament, he argued.

The General Legislation Committee should have rejected the discussion of the bill submitted by the government, he added, calling for the need to reach a consensual solution in the respect for the constitution.

The organic draft law No. 16-2015 on the supreme judicial council has been returned to the HPR after the constitutional review authority ruled nine articles of that bill unconstitutional.
